About David
David has spent the past fourteen years representing California public-sector labor unions. His experience includes:
- Labor negotiations: drafting proposals, representing unions at the table, mediation, impasse, fact-finding, and labor action (strikes). Represented a union through a successful strike and salary negotiations.
- Proceedings before the Public Employment Relations Board (“PERB”): drafting and prevailing on bad faith bargaining, direct dealing, unilateral change, and retaliation charges. Obtained a backpay/back benefits award in a unilateral change case totaling over one million dollars.
- Grievances and arbitrations: preparing grievances, representing unions in arbitrations including salary disputes, employee discipline, and tenure denials. Obtained employee reinstatements after misconduct investigations and tenure denials.
- Much more: retiree benefit litigation, layoff proceedings, unemployment insurance hearings, Title IX matters, misconduct investigations, representing unions against duty of fair representation (“DFR”) and bargaining charges, drafting labor-oriented legislation, protecting faculty free speech rights, and representation for unit modification proceedings. Numerous DFR and bargaining charges against unions dismissed, prevailed in a one-million-dollar retiree benefit award.
David regularly leads workshops and training seminars for union officers on topics such as labor negotiations and employer investigations. He has been repeatedly recognized as a Northern California Rising Star Super Lawyer, a recognition given to no more than 2.5% of active practicing attorneys in the state.
Before opening his own firm, David was partner at a four-attorney legal office in Oakland, CA. He also clerked for the California Teachers Association, and externed for the National Labor Relations Board, where his primary responsibilities included investigating charges and drafting recommendations for completed investigations for the Supervisory Attorney and Regional Director.
David graduated from the University of Washington in May 2004 with a B.A. in Business Administration, and from University of California, Hastings College of Law in May 2007. He was admitted to the California Bar in December 2007. In his free time, he enjoys doing crossword puzzles, playing board games, and spending time with his wife, son, and rescue dogs.
